NOTICE OF REGULAR MEETING OF THE TOWN OF CAREFREE COMMON COUNCIL

WHEN: TUESDAY, OCTOBER 1, 2013

WHERE: CAREFREE TOWN HALL COUNCIL CHAMBERS

TIME: 5:00 P.M.

Pursuant to A.R.S. 38-431.02, notice is hereby given to the members of the Common Council of the Town of Carefree, Arizona and to the general public that the members of the Common Council will hold a meeting open to the public on Tuesday October 1, 2013 at 5:00 p.m. at the Carefree Town Hall Council Chambers located at 100 Easy Street, in Carefree, Arizona.

The agenda for the meeting is as follows:

Call to Order, Silent Roll Call and Pledge of Allegiance.

REGULAR AGENDA:

ITEM #1 Presentation and discussion with Karen Fann, Arizona State Representative, Legislative District 1.

ITEM #2 Presentation and discussion with Albert Holler of Albert Holler & Associates regarding Use Tax in Arizona.

CONSENT AGENDA

All items listed hereunder are considered to be routine by the Common Council and will be enacted by one motion. There will be no separate discussion of these items unless a Councilmember so requests, in which event the item will be removed from the consent agenda and will be discussed separately:

ITEM #3 Approval of September 10, 2013 Regular Session Town Council Meeting Minutes.

ITEM #4 Acceptance into the public record of the September, 2013 paid bills.

ITEM #5 Acceptance of the cash receipts and disbursements report for August, 2013.

ITEM #6 Approval of the Special Event Permit Applications of Magic Bird Festivals, LLC for theArt of the Southwest Festival on January 24, 25, and 26, 2014 for the Indian Market and

Cultural Festival; February 13, 14, 15 and 16, 2014 for the Festival of Fine Chocolate &

Fine Art; and April 11, 12, and 13, 2014 for the Carefree Days Festival with street

closure to begin on the day before the event at 6:00 a.m.

ITEM #7 Approval of the Special Event Permit Application of 6th Annual Carefree Christmas Festival on December 13, 14 & 15, 2013 including:

A. Street closure of the eastbound right lane of Cave Creek Road, Bloody Basin from

Cave Creek Road to Nonchalant, Nonchalant from Bloody Basin to Easy Street and

all of Easy Street and all of Sundial Circle from 2 p.m. to 10 p.m. on Saturday,

December 14, 2013 for the Carefree Christmas Parade, and

B. Street closure of Ho Hum between Easy Street and the parking lot at 100 Easy Street

from Thursday, December 12, 2013 at 6 a.m. to Sunday, December 15, 2013 at 5

p.m. with a fireworks display at 8 p.m. on December 14, 2013 for the Carefree

Christmas Festival.

ITEM #8 Approval of the Special Event Permit Applications of Sonoran Arts League/Vermillion Promotions for an Art Festival March 21, 22 and 23, 2014 with street closure to begin on March 20, 2014 at 5:00 p.m. with street closure of Easy Street from Wampum Way to and including the west side of Sundial Circle to, and including, Ho-Hum Street.

ITEM #9 Approval of an Application for Wine Festival License for the Carefree Fine Art & Wine Festival by Tough Country Winery from 10:00 a.m. to 5:00 p.m. on November 1, 2, and 3, 2013.

REGULAR AGENDA:

ITEM #10 Call to the Public: Consideration and discussion of comments and complaints from the public. Pursuant to Section 2-4-7 G of the Town Code and A.R.S. 38-431.01(G), those wishing to address the Council need not request permission in advance. Action taken as a result of public comment will be limited to directing staff to study the matter or

rescheduling the matter for further consideration and decision at a later date. The public

may address the Council on any matter not on the agenda. At the conclusion of an open

call to the public, individual members of the public body may respond to criticism made

by those who have addressed the public body, may ask staff to review a matter or may

ask that a matter be put on a future agenda; however, the Council may not take action at

this time. Please limit your comments to not more than 3 minutes.

ITEM #11 Current Events.

ITEM #12 Discussion and possible action to approve Resolution 2013-06 changing the General Plan future land use category of the Town of Carefree General Plan 2030 on certain real property described in General Plan Minor Amendment Application #13-07-GP from Rural Residential (RR) to Open Space/Recreation (OS/R).

ITEM #13 Discussion and possible action to approve Ordinance 2013-04 changing zoning from Rural-190 to Open Space-Recreation (OS-R), on approximately 50.06 acres of open

space property owned by the Town of Carefree, located at the northern Town limits and

amending the Town of Carefree Zoning District Map to reflect this rezoning.
