NOTICE OF REGULAR MEETING OF THE TOWN OF CAREFREE COMMON COUNCIL

WHEN: TUESDAY, NOVEMBER 5, 2013

WHERE: CAREFREE TOWN HALL COUNCIL CHAMBERS

TIME: 5:00 P.M.

Pursuant to A.R.S. 38-431.02, notice is hereby given to the members of the Common Council of the Town of Carefree, Arizona and to the general public that the members of the Common Council will hold a meeting open to the public on Tuesday November 5, 2013 at 5:00 p.m. at the Carefree Town Hall Council Chambers located at 100 Easy Street, in Carefree, Arizona.

The agenda for the meeting is as follows:

CALL TO ORDER

SILENT ROLL CALL and PLEDGE OF ALLEGIANCE

One or more members of the Council may be unable to attend the Council meeting in person and may participate telephonically pursuant to A.R.S. §38-431(4).

REGULAR AGENDA:

ITEM #1 Presentation and discussion with Senator Steve Pierce, Arizona State Senate

District 1.

ITEM #2 Presentation and discussion with Jo Gemmill regarding the Carefree Christmas

Festival.

CONSENT AGENDA

All items listed hereunder are considered to be routine by the Common Council and will be

enacted by one motion. There will be no separate discussion of these items unless a

Councilmember so requests, in which event the item will be removed from the consent agenda and will be discussed separately:

ITEM #3 Approval of October 1, 2013 Regular Session Town Council Meeting Minutes.

ITEM #4 Approval of October 7, 2013 Regular Session Town Council Meeting Minutes.

ITEM #5 Acceptance into the public record of the October, 2013 paid bills.

ITEM #6 Acceptance of the cash receipts and disbursements report for September, 2013.

ITEM #7 Approval of an Application for Special Event Liquor License for Foothills

Animal Rescue, Inc. on November 21, 2013 from 5:30 p.m. to 8:30 p.m.

REGULAR AGENDA:

ITEM #8 Call to the Public: Consideration and discussion of comments and complaints

from the public. Pursuant to Section 2-4-7(G) of the Town Code and A.R.S. 38-

431.01(G), those wishing to address the Council need not request permission in

advance. Action taken as a result of public comment will be limited to directing

staff to study the matter or rescheduling the matter for further consideration and

decision at a later date. The public may address the Council on any matter not on

the agenda. At the conclusion of an open call to the public, individual members of

the public body may respond to criticism made by those who have addressed the

public body, may ask staff to review a matter or may ask that a matter be put on a

future agenda; however, the Council may not take action at this time. Please limit

your comments to not more than 3 minutes.

ITEM #9 Current Events.

ITEM #10 Discussion and possible action regarding 2012-2013 Fiscal Year audit.

A representative from the firm of HintonBurdick, PLLC will attend

telephonically.

ITEM #11 Discussion and possible action to approve Ordinance 2013-05, an Ordinance of

the Town of Carefree, Arizona, relating to the Privilege License Tax; adopting the

“Town of Carefree Use Tax”, providing penalties for the violation thereof;

providing severability and establishing an effective date. (First Reading)

ITEM #12 Discussion and possible action to approve Ordinance 2013-08 of the Town of

Carefree, Arizona, amending Article 4-7 of the Town Code of the Town of

Carefree, Arizona by amending Section 4-7-(B)(1) to assess an Enhancement Fee

of $25.00, and that this Ordinance shall be effective on January 1, 2014, after its

passage, adoption and approval by the Mayor and Common Council of the Town

as required by law and directing the Town Clerk of the Town of Carefree to

incorporate this amendment into the Town of Carefree Town Code. (First

Reading).

ITEM #13 Discussion and possible action to approve Ordinance 2013-06 amending Article

VIII - Signs Permitted of the Carefree Zoning Ordinance regarding real estate

signs and open house signs.

ITEM #14 Discussion and possible action to approve Ordinance 2013-07 amending Article

11-3-3 of the Carefree Town Code regarding the permits and posting requirements for open house signs located in the Town right-of-ways.

ITEM #15 Discussion and possible action for approval of the following contracts for the

continued improvements to the Sanderson Lincoln Pavilion:

A. Approve a contract with Total Shade, LLC for additional shade purchase and

installation

B. Approve a contract with Technically Integrated for the installation of

audio/visual and electrical services.

ITEM #16 Discussion and possible action to go into Executive Session in accordance with

A.R.S. 38-431.03(A)(1) and (A)(3) to receive legal advice concerning development proposals in Carefree Town Center.
