Carefree Truth

The 1st reading took place of an amendment to the Carefree Town Code that is part of the Carefree/Cave Creek Municipal Court consolidation process.  The jurisdictions must charge equivalent court enhancement fees.  Currently, the Carefree Court assesses a flat $30 fee, inclusive of any state mandated surcharges, keeping $16.67.  Cave Creek, like many other courts in the area, charges $25 plus the state fees, keeping $25.  Currently, defendants found guilty in Carefree are being subsidized by the Carefree court.  This would eliminate that subsidy.

 

 

 

Councilman Glenn Miller asked Gary Neiss to explain for the record how court enhancement fees are used.  Mr. Neiss said they are used for improvements to the physical space as well as for reimbursement of operational costs.  Vice Mayor Les Peterson said it is his understanding that approximately 96% of those who come before the Carefree Court are not Carefree residents, but are those passing through who are speeding or otherwise disobeying a law.  Mayor David Schwan reminded the Council and the audience that only those found guilty as assessed the fee.

 

 

 

No action was taken.  The 2nd reading will take place at the December Council meeting, and if passed, the amendment will be implemented in January.
