When the state legislature originally passed a law allowing the private sale and use of fireworks, municipalities were given the option to ban it within their borders. This past spring, the legislature changed the law to allow the private sale of fireworks within all of Maricopa County from June 24th-July 6th and December 24th-January 3rd. Carefree was required to amend the ordinance that restricted fireworks in order to comply with the revised state statute. The proposed revised wording was in accordance with the state revision. The civil penalty for sale and use at other times was changed from $750 to $1000, again as per state law.
Councilman Marty Saltzman asked for a clarification on whether it applied just to sales, or to use as well. Gary Neiss confirmed that it applied to both. Mr. Saltzman quipped, "Just a quick question. Who's got the firework lobby in this state?" Vice Mayor Les Peterson added, "It must be powerful." Councilman John Crane opined, "It defies common sense." Councilman Mike Farrar agreed. The Vice Mayor stressed that the ordinance is being modified to be consistent with state law. Mr. Saltzman said, "I assume we're absolutely required to modify ours. We can't hold out?" Mr. Niess answered, "Correct." The Council unanimously but reluctantly approved the amendment to comply with the revisions in the state law.
