Acting Mayor Les Peterson presented an update of the ongoing discussions, initiated by Venues Cafe, between the Town of Carefree and the Arizona Corporation Commission (ACC) regarding the high sewer rates being charged to Carefree restaurants by Black Mountain Sewer/Liberty Water Co. (BMS/LWC).  He explained that the ACC is a cumbersome and regulation bound entity that won't make changes until the next rate case is heard.  

 

 

 

Calculations of sewer quantities can be based on either the number of seats in a restaurant, or on the number of meals served.  BMS/LWC has taken the position that it is up to them to decide which method is used.  They chose to use option #1. 

 

 

 

Acting Mayor Peterson, Councilman John Crane, and Town Administrator Gary Neiss met with the ACC staff.  Marketing Director Gina Kaegi has been speaking with the restaurant owners to collect data.  The ACC has looked at the information on the amount of water going into the restaurants, and has found it was 1/3 of the amount being billed for sewage.  They have acknowledged that the situation is incorrect.  

 

 

 

Town Attorney Mike Wright is working to put it before the ACC to be heard, and the Acting Mayor feels the ACC is very receptive.  He is "cautiously optimistic" but said some "good inroads" are being made.  They appear to be accepting Carefree's reasoning as coinciding with their own.
