(Lyn's note: Please feel free to send us any pictures you'd like included.  If your photos are for sale, let us know and we will put them under that category.  We have a special section for that purpose, and have just added some art as well.  Check out Tom Baker's photos for sale.  He's the photographer who took that gorgeous photo in the Carefree Gardens Photo Contest that was both the judges' first pick and the public favorite.  It's now featured on the Town of Carefree website, and will be the cover of the 2014 Gardens calendar that will be for sale later this summer at Carefree Town Hall.  If anyone would like to buy a print of any of Herbert's photos, all profits will be donated to one of the local non-profit organizations.)  Here's the link to this week's Pictures of the Week.

Pedestrian Safety

Pedestrians must act responsibly in keeping themselves safe by following Arizona State Law and follow a few simple tips:

  1. Before stepping off the curb into a crosswalk, stop and look both ways to be sure that approaching cars and bicycles see you and stop for you. Although pedestrians have the right-of way in a crosswalk (ARS 28-792A), not all drivers will stop, particularly if the driver’s view of you is blocked by other traffic or the driver is distracted.

  2. Walk, don’t run. Per Arizona State law, pedestrians shall not suddenly leave the curb or other place of safety and walk or run into the path of an on-coming vehicle in a manner in which it is impossible for the driver to yield to the pedestrian (ARS 28-792A). Please note that this law is applicable to entering cross walks.

  3. When crossing the street in a crosswalk, pedestrians shall move expeditiously, when practicable on the right half of crosswalks (ARS 28-795). Don’t loiter or cause undue delay crossing the roadway.

  4. Pedestrians need to cross the street in crosswalks where the pedestrian has the right-of-way. If a pedestrian crosses a roadway and is not in crosswalk, vehicles have the right-of-way and pedestrians must yield to the vehicle, Arizona Revised Statutes (ARS) 28-793A.

Arizona uses what's known as the ‘pure' comparative negligence standard. In these cases, the court will decide which party is responsible for which percentage of the total fault, and if the defendant is liable for any of the harm the plaintiff's damages are reduced by the amount that he or she was also negligent. These cases tend to arise when a pedestrian was crossing against traffic or suddenly darted into the street without much of an opportunity for the motorist to avoid the collision.
